TERMS AND CONDITIONS
GENERAL CONDITIONS OF SALE
1) ACCEPTANCE AND SCOPE OF APPLICATION
1.1. These general conditions of sale (hereinafter referred to as "General User Conditions" or even just "General Conditions") apply exclusively to the sale of the Products shown on the Site via the web.
1.2. These General Conditions, available in Italian and English, form an integral part of the Contract, as defined below, and placing an Order implies their acceptance by the User.
1.3. These General Conditions are added to any further terms and conditions that may be contained in the individual dedicated sections of the Site visited from time to time by the User and have an indefinite duration.
1.4. In the event of any conflict between these General Conditions and the provisions contained in the individual dedicated sections of the Site, the latter will prevail.
JG HITECHNOLOGY reserves the right to unilaterally modify, at any time, these General Conditions as well as the terms and conditions contained in the dedicated sections of the Site as well as in each individual Purchase Offer, with communication to be made to Users through general notices published in network on the Site. Unless otherwise specified, all the new provisions of the General Conditions will be automatically effective after fifteen (15) days from the date of publication on the Site. It remains understood that the applicable conditions of sale are those in force on the date of transmission of the Order.
1.5. The User is informed that these General Conditions can be consulted on the Site and can be saved using the relative browser command.
2) DEFINITIONS
2.1. For the purposes of the validity and effectiveness of these General Conditions, the following terms will have the meaning respectively assigned below:
- "Reserved Area": the area of the Site reserved for the User which the same accesses, after completing the registration procedure, by entering the ID and password;
- "Causes of Force Majeure": by way of example and without any limiting intent, we consider causes of force majeure lockouts, strikes, absolute lack of means of transport, wars, riots or other military actions, floods, fires, lightning strikes or other catastrophes natural forces, explosions, accidents, power outages, interruptions, malfunctions or overloads of telephone or telematic lines, delays or defaults by third party suppliers or couriers or any other event that is beyond the reasonable sphere of control of JG HITECHNOLOGY and which prevents the full and correct fulfillment of the obligations set out in the General Conditions for the same;
- "Consumer Code": Legislative Decree no. 206/2005 as amended;
- "Consumer": the natural person who has completed the online authentication procedure for the purchase of Products for purposes and purposes unrelated to any entrepreneurial, commercial, craft or professional activity carried out, pursuant to and by effect of the Code of Consumption;
- "Contract" the sales contract concluded remotely through the Site between the User and JG HITECHNOLOGY upon receipt of the confirmation e-mail by the User to the e-mail address indicated by the latter at the time of registration on the Site;
- "JG HITECHNOLOGY": means the company JG HITECHNOLOGY Srl, with registered office in Calderara di Reno (BO), Via Aldina 12 (CF and VAT number 03632401208), REA number BO-535004.
- "Offer": the offer of a Product according to the terms and conditions better specified in the Offer itself as published in the dedicated section of the Website;
- "Order": the purchase order for the Products filled in and forwarded exclusively through the Site and in the manner indicated therein;
- "Parties": the User and JG HITECHNOLOGY collectively;
- "Price": the sale price of each Product as indicated in the Offer;
- "Professional": the natural or legal person or other body or organization, of public or private law, who has completed the online authentication procedure for the purchase of the Products for purposes and purposes connected to the entrepreneurial, commercial, artisanal activity o professional performance, pursuant to and by effect of the Consumer Code;
- "Product": the products offered for sale by JG HITECHNOLOGY on the Site;
- “Site”: internet platform managed by JG HITECHNOLOGY, exclusive owner of the related property, use and enjoyment rights, at the address http://www.jghitechnology.com in order to offer Users the goods better identified therein;
- User": means, without distinction, the Professional or the Consumer who accesses and purchases through the Site.
3) METHOD OF CONCLUDING CONTRACTS
3.1. The purchase of the Products through the Site will take place exclusively through the internet and only after the User has registered on the Site in the manner indicated therein.
3.2. Registration on the site is free. To register on the Site, the User must fill in the appropriate form, entering his name, surname, e-mail address and a password and click on the "Save" button. The e-mail address and password entered will allow him to access his own Reserved Area.
3.3. Once registered and before sending the Order, which takes place by clicking on the "Proceed with the purchase" button, the User will be asked to read and accept these General Conditions by selecting the appropriate box.
3.4. Before sending the Order, the User will have the possibility to verify, through a summary page of the Order itself, the correctness of the data entered as well as to modify the Order and/or correct any entry errors.
3.5. Once the Order has been submitted, the User will be sent an e-mail confirming the successful purchase to the e-mail address indicated during registration, containing the receipt of the Order placed (with a description of the Products purchased, the Price, delivery costs and Order number) as well as a link to download and archive a copy of these General Conditions. It remains understood that, by accessing their Reserved Area, the User will have the possibility of viewing the summary of the Orders placed at any time in the appropriate "Order history and details" section.
3.6. Finally, the User is informed that the Orders are stored in digital form on the server.
4) DESCRIPTION OF THE OFFER
4.1. By accessing the Site, the User will be able to view and compare the various Offers of the Products available.
4.2. Each Offer contains the description of the Product, the Price, the payment and delivery methods and the additional terms and conditions for the purchase, the number of Products available and/or purchasable as well as any other information necessary to finalize the purchase of the Product .
4.3. The availability of the Products refers to the actual availability at the time the User sends the Order. The User acknowledges and accepts that this availability is purely indicative since, due to the simultaneous presence of several Users on the Site, the Products could be sold to other Users before completing the Order.
4.4. Any images or photographs shown in the Offer do not constitute a contractual element but are purely indicative and symbolic.
4.5. All the Prices indicated on the Site are expressed in Euros and in pounds sterling and include VAT and, where applicable, the WEEE contribution.
4.6. Delivery costs are not included in the amount indicated by way of Price. They are always charged to the User and will be calculated and detailed immediately before payment and, in any case, shown in the Order summary referred to in point 3.4 and in the Order receipt referred to in point 3.5.
4.7. JG HITECHNOLOGY reserves the right to modify the Prices of the Products at any time, it being understood that the Price applicable to each individual purchase is the one indicated on the Site at the time the Order is sent.
4.8. JG HITECHNOLOGY reserves the right to cancel a confirmed Order for the following reasons:
(i) due to lack of availability of the Products according to the provisions of point 4.3;
(ii) if the security systems indicate that it may be a fraudulent Order;
(iii) if it emerges that the User is a minor;
(iv) if the place of delivery is not among the countries to which JG HITECHNOLOGY can ship the purchased Products.
In the hypotheses listed above, JG HITECHNOLOGY will inform the User via e-mail and refund the amount paid by the User by way of Price as well as by way of delivery costs, with the exclusion of the recognition of any compensation.
5) PAYMENT METHODS AND REFUNDS
5.1. Payment for the Order must be made when the Order is forwarded to JG HITECHNOLOGY exclusively by one of the means described in the following articles:
5.2. Pay Pal
In case of payment by PayPal account, the User will be redirected to the website www.paypal.it where he will make the payment according to the procedure established and governed by PayPal and the contract conditions agreed by the User with PayPal. The data entered on the PayPal site will be processed directly by the same and will not be transmitted or shared with JG HITECHNOLOGY. JG HITECHNOLOGY is therefore not able to know and does not store in any way the credit card data connected to the User's PayPal account or the data of any other payment instrument connected with this account.
5.3. Credit, debit or prepaid cards
Payment can be made by credit, debit or prepaid card directly through the Site. JG HITECHNOLGY accepts cards from the Visa, Visa Electron, Mastercard, American Express circuits. Also in this case the payment will be managed through the intermediary circuit to whose site the User will be redirected with the possibility of entering the data of the card he intends to use. The data entered on the intermediary's website will be processed directly by the intermediary and will not be transmitted or shared with JG HITECHNOLOGY. JG HITECHNOLOGY is therefore not able to know and does not store in any way the data of the card used for the purchase.
5.4. Postepay top-up
The payment must be made to Postepay, whose data will be sent to the User in a special e-mail that he will receive after sending the Order. In this case, the e-mail confirming the purchase, containing the receipt of the Order placed, as well as the Products ordered will be shipped only after receipt of the credit on Postepay.
5.5. Bank transfer
The bank transfer must be made on the bank details that will be sent to the User in a special e-mail that he will receive after sending the Order. The reason for the transfer must include the Order number and the User's name and surname. Any bank charges will be charged to the User. In case of payment by bank transfer, the e-mail confirming the purchase, containing the receipt of the Order placed, as well as the Products ordered will be shipped only after receipt of the credit on the bank account of JG HITECHNOLOGY.
5.6. For the purchase of Products on the Site, payment methods other than those expressly specified in these General Conditions or in the "Payment method information”.
5.7. In the event of a request, JG HITECHNOLOGY will issue and send the invoice relating to the Order by e-mail to the User following delivery of the Product. The invoice request must be made before sending the Order. For the issuance of the invoice, the information provided by the User at the time of registration on the Site and/or completion of the Order will be considered. No change in the invoice will be possible after it has been issued.
5.8. Any refund to the User will be made with the same payment methods adopted by the User for the purchase of the Product. In case of payment by Postepay top-up, the User will be asked to inform JG HITECHNOLOGY of the methods by which to reimburse the amount due.
5.9. All communications relating to payments take place on a special line protected by an encryption system.
5.10. JG HITECHNOLOGY has adopted adequate technical and organizational measures to safeguard the security of its services on www.jghitechnology.com, the integrity of data relating to traffic and electronic communications with respect to unauthorized forms of use or knowledge, as well as to avoid the risk of dispersion, destruction and loss of data and confidential and non-confidential information relating to its Users, present on www.jghitechnology.com, or of unauthorized access, or access not in compliance with the law, to the data and information themselves.
5.11. JG HITECHNOLOGY assumes no responsibility for any fraudulent or illegal use that may be made by third parties of credit cards and other means of payment, upon payment for the Products purchased through the Site, if it demonstrates that it has adopted all the precautions possible on the basis of ordinary diligence.

6) METHODS, TIMES AND COSTS OF DELIVERY
6.1. The purchased Products will be delivered within the term indicated by JG HITECHNOLOGY in the Order Confirmation email and, in any case, no later than thirty (30) days from the completion of the Contract to the address provided by the User when sending of the Order.
6.2. As an alternative to home delivery referred to in point 6.1 above, the User can choose, by selecting the appropriate box, the option for collection in the company: in this case the User must personally collect the Products from the address indicated by JG HITECHNOLOGY providing the Order number.
6.3. At the time of shipment, the User will be sent an e-mail confirming delivery to the carrier which will also contain the code through which the User can check the status of the shipment; the User can in any case follow the tracking of the shipment of the Products directly in the section relating to the order status within his own Reserved Area.
6.4. The shipping costs are charged to the User: the relative amount is calculated and detailed separately from the Price on the Order summary page, before confirmation via the "Proceed with purchase" function as well as in the Order receipt referred to in point 3.4.
6.5. The delivery of the purchased Products may take place, at the User's choice, through one of the following methods: Standard, Rapid or delivery in the company.
6.6. JG HITECHNOLOGY declines all responsibility for any delay in the delivery of the purchased Products if this derives from Force Majeure.
6.7. The risk of damage and/or loss of the Products rests with JG HITECHNOLOGY until the moment of delivery of the same to the User or to a representative designated and indicated in advance to JG HITECHNOLOGY.
6.8. For more details about delivery methods, costs and terms, please refer to the appropriate informative of the section "Methods, terms and costs of delivery".
7) WARRANTY
7.1. JG HITECHNOLOGY guarantees the Products for a period of five (5) years from their delivery and therefore longer than that established by law.
7.2. Without prejudice to the longer duration of the guarantee period offered by JG HITECHNOLOGY referred to in the previous point 7.1., in the case of Contracts concluded with Consumers, the provisions of the Consumer Code regarding the guarantee for defects of non-conformity will apply for the rest of the products. Therefore, in order to take advantage of the guarantee, the Consumer must report the lack of conformity to JG HITECHNOLOGY within and no later than sixty (60) days from its discovery. In the event of an ascertained lack of conformity, the Consumer may ask, at his choice, JG HITECHNOLOGY to repair the Product or replace it, free of charge in both cases, unless the requested remedy is objectively impossible or excessively onerous compared to the other .
7.3. Without prejudice to the longer duration of the guarantee period offered by JG HITECHNOLOGY referred to in the previous point 7.1., in the case of Contracts concluded with Professionals, the legal guarantee provided for in the Civil Code will apply for the rest. In any case, the Professional will be required to report any faults or defects in the Product delivered no later than eight (8) days after discovery. JG HITECHNOLOGY will, depending on the case and at its discretion, repair or replace the Product, with the exclusion of any indemnity or other compensation in favor of the Professional User.
7.4. In order to request intervention under warranty, the User, Consumer or Professional must provide proof of purchase, describing the defect or discrepancy found.
7.5. The guarantee is excluded in the following cases:
(i) if the defects or non-conformities of the Product purchased are due to improper, imperative or negligent use;
(ii) if the Product has been stored incorrectly;
(iii) if third parties other than JG HITECHNOLOGY have intervened on the Product;
(iv) in the event of scratches or damage caused by impact or accident;
(v) if the Product has been tampered with.
8) INTELLECTUAL PROPERTY
8.1. The User expressly acknowledges that JG HITECHNOLOGY is and will remain the sole and exclusive owner of any intellectual property right, whether registered or not, on the Products and advertising content and in particular on images, texts, graphics, logos, icons, distinctive signs and buttons, as well as on commercial names, trademarks or industrial designs and any other sign susceptible of industrial and commercial use and that the acceptance of these General Conditions and the conclusion of the Contract do not imply transfer or licence, total or partial, of any right of intellectual property on the aforementioned contents.
8.2. Furthermore, the User expressly acknowledges that the trademarks, patents, trade names or other distinctive signs affixed to the Products cannot be altered, abused, reproduced, removed, distributed or publicly communicated without the prior express authorization of JG HITECHNOLOGY.
9) CONSUMER WITHDRAWAL
9.1. The Consumer has the right to withdraw from each individual Contract without any penalty and without giving any reason, within the term of fourteen (14) days from the date on which he received the purchased Product (or the last Product in the case of multiple Products delivered separately).
9.2. The withdrawal referred to in point 9.1 above must be exercised by informing JG HITECHNOLOGY of the intention to unilaterally dissolve the Contract through any written and explicit declaration to that effect or by using the standard withdrawal form which can be downloaded here to be sent by registered letter, fax, e-mail or PEC to the addresses indicated in point 12.1.
9.3. Within fourteen (14) days of sending the notice of withdrawal referred to in point 9.2 above, the Consumer is required to return the Products to JG HITECHNOLOGY, at his own expense and risk, using a carrier of his choice. The deadline is met if the Consumer sends back the Products before the period of fourteen (14) days has expired.
9.4. The Products must be returned:
a) correctly packed in their original packaging, undamaged, undamaged and equipped with all accessories, instructions for use and documentation;
b) with no signs of use other than those compatible with carrying out a normal test of the Product (for example: it must not bear traces of prolonged use or in any case exceeding the time necessary for a test and must not be in such a state as not to allow for resale).
9.5. Once the Consumer's notice of withdrawal has been received, JG HITECHNOLOGY will verify the conformity of the returned Products with the provisions of point 9.4 above. If the verification is successful, JG HITECHNOLOGY will reimburse without delay, according to the procedures set out in point 5.8 of these General Conditions, the entire amount paid by the Consumer User in his favor for the purchase of returned Products including delivery costs ( with the exception of the additional expenses deriving from the choice, by the Consumer, of a delivery method other than the ordinary and less expensive one), with the exclusion of the recognition of any compensation.
9.6. In the event that the Product for which the withdrawal has been exercised has suffered a decrease in value resulting from a manipulation other than that necessary to establish its nature, characteristics and functioning, the sum to be refunded will be reduced by an amount equal to this decrease in value. JG HITECHNOLOGY will communicate the circumstance and the consequent reduced refund amount to the Consumer User by e-mail.
9.7. The methods for returning the purchased Product or replacing it can also be consulted in the section "Returns and replacements information”.
10) LIMITATION OF LIABILITY
10.1. The maximum liability of JG HITECHNOLOGY for damages deriving from the single Contract or connected to its execution cannot exceed the amount paid by the User for the Order to which the claim refers, without prejudice to the applicability, for Consumers, of the limits referred to in the Consumer Code (articles 33 and following).
11) GENERAL CLAUSES
11.1. The General Conditions contain the overall agreement reached by the Parties with respect to the subject of the same and they prevail over all previous communications, declarations, as well as the understandings and agreements, both oral and written, reached by the Parties.
11.2. If any provision of these General Conditions is declared null, voidable or unenforceable, all the other conditions and provisions of these General Conditions will remain, in any case, fully valid and effective.
11.3. JG HITECHNOLOGY and the Users act in full autonomy and independence. These General Conditions do not give rise to any collaboration, agency, association, intermediation or employment relationship between them.
11.4. Any tolerance on the part of JG HITECHNOLOGY towards any breaches by the User of the provisions of these General Conditions does not constitute a waiver of the rights deriving from the violated provisions nor of the right to demand the correct fulfillment of all the provisions of the General Conditions themselves .
12) COMMUNICATIONS
and written communications addressed to JG HITECHNOLOGY, including those of withdrawal referred to in point 9.2, will be considered valid only if sent to JG HITECHNOLOGY at the following address: Via Achille Grandi n. 14/b, Calderara di Reno (BO) or sent by e-mail to the following addresses: info@jghitechnology.com, Certified Mail: jgcert@pec.jghitechnology.com, or by Fax 051/4110735.
12.2. The User is required to indicate in the registration form the e-mail address to which he wishes to receive communications from JG HITECHNOLOGY.
13) TREATMENT OF PERSONAL DATA
13.1. The data provided by the User are processed by JG HITECHNOLOGY in compliance with the provisions of Legislative Decree no. 196/2003, as better specified in the privacy information provided in the specific section "Privacy disclaimer”.
14) APPLICABLE LAW AND REFERRAL
14.1. These General Conditions, as well as the terms and conditions of the individual Offers and individual Contracts are governed and subject, even for what is not expressly provided for, to Italian law, with the exclusion of the application of any different law.
15) JURISDICTION
15.1. Any dispute relating to the application, interpretation and validity of these General Conditions, the terms and conditions contained in each individual Offer or individual Contracts will be subject to the jurisdiction of the Italian State and to the exclusive jurisdiction of the Court of Bologna (IT).
15.2. Notwithstanding the provisions of point 15.1, the Consumer who intends to establish a jurisdictional dispute relating to the application, interpretation and validity of these General Conditions as well as the terms and conditions contained in each individual Offer, may appeal to the Court of Bologna or the local Court of residence or domicile of the Consumer if located in the territory of the Italian State.
15.3. Without prejudice to the provisions of point 15.2 above, the Consumer will in any case have the possibility of using the ODR (Online Dispute Resolution) web platform made available by the European Commission for the resolution of online disputes, by accessing it via the following link:_cc781905- 5cde-3194-bb3b-136bad5cf58d_http://ec.europa.eu/consumers/odr/.
15.4. If the Consumer is not domiciled in the territory of a State of the European Union, the provisions of Law no. 218/1995.
GENERAL CONDITIONS OF USE
1) VALIDITY AND SCOPE
The access and use of the site http://www.jghitechnology.com ("Site") by the user who accesses and purchases it ("User") are governed by these general conditions of use (" General Conditions of Use”) as well as the General Conditions of Sale and presuppose their reading, knowledge and acceptance.
The products that can be purchased through the Site ("Products") are sold directly by JG HITECHNOLOGY Srl, with registered office in Calderara di Reno (BO), Via Achille Grandi n. 14/b (Tax Code and VAT number 03632401208), REA number BO-535004 (“JG HITECHNOLOGY”).
JG HITECHNOLOGY reserves the right to unilaterally modify, at any time, these General Conditions of Use. Unless otherwise specified: all the new provisions of the General Conditions of Use will be automatically effective after fifteen (15) days from the date of publication on the Site.
These General Conditions of Use are added to any further terms and conditions that may be contained in the individual dedicated sections of the Site visited from time to time by the User and have an indefinite duration.
In the event of any conflict between these General Conditions of Use and the provisions contained in the individual dedicated sections of the Site, the latter shall prevail.
2) USE OF THE SITE BY THE USER
The User guarantees that all the data and information provided at the time of registration are true and complete and undertakes to promptly communicate any changes to the aforementioned data and information, updating them through the appropriate "Login" section of the Site.
The User may request the cancellation of his account from the Site at any time by contacting JG HITECHNOLOGY at the email address info@jghitechnology.com.
The User is required to take all necessary precautions to keep his username and password confidential and will be personally responsible for all activities that will be carried out with his credentials.
The User exonerates the Site from any liability deriving from improper use of the password by third parties who have become aware of it, in any way.
The User also undertakes to immediately inform JG HITECHNOLOGY if he has reason to believe that a third party has become aware of his password and may use it or has already used it in an unauthorized manner.
The User is required not to use the Site:
(i) in such a way as to cause, or could cause, interruptions, damages or malfunctions to the Site and its features;
(ii) to commit activities that are directly or indirectly illegal or not permitted other than by these General Conditions of Use, by law or by the General Conditions of Sale;
JG HITECHNOLOGY reserves the right to prevent access to the Site, to suspend or close an account and to remove or modify the contents of the Site at its discretion in case of violation of the applicable legal provisions or of these General Conditions of Use.
3) COMMENTS
Only registered Users are allowed to publish comments and reviews on the Products, provided that they are the same
(i) have no unlawful or otherwise defamatory, obscene, aggressive, violent, discriminatory content;
(ii) do not contain advertising information referring to subjects other than JG HITECHNOLOGY;
(iii) do not violate the privacy rights of other subjects.
With the use of this service, the User authorizes JG HITECHNOLOGY to publish and therefore make the content of the same public domain, renouncing any compensation or indemnity. It is understood that the User may, at any time, request the cancellation of the comment by contacting JG HITECHNOLOGY at the email address info@jghitechnology.com.
JG HITECHNOLOGY reserves the right to remove, in whole or in part, the contents of the comments published by the Users and having content contrary to the aforementioned provisions.
The User is personally responsible for the content of his comments and undertakes to indemnify and hold JG HITECHNOLOGY harmless from and against any liability and prejudicial consequence deriving from comments that do not comply with the aforementioned provisions.
4) LIMITATION OF LIABILITY
JG HITECHNOLOGY does not guarantee that the Site will operate continuously, without interruptions and in the absence of errors or malfunctions due to the internet connection.
Furthermore, JG HITECHNOLOGY assumes no responsibility for any damage to computer systems or loss of data resulting from the download operations of content from the Site or for those deriving from inaccessibility to the Site or caused by viruses, damaged files, errors, omissions, service interruptions, deletion of content, problems connected to the network, providers or telephone and/or telematic connections, unauthorized access, data alterations, failure and/or defective functioning of the User's electronic equipment.
5) PRIVACY
The User is invited to carefully read thePrivacy Policy which also applies if the User accesses the Site without purchasing any Product. The Privacy Policy helps the User to understand how JG HITECHNOLOGY collects and uses your personal data and for what purposes.
6) INTELLECTUAL PROPERTY
The User expressly acknowledges that JG HITECHNOLOGY is and will remain the sole and exclusive owner of any intellectual property right, whether registered or not, on the Products and advertising content and in particular on images, texts, graphics, logos, icons, distinctive signs and buttons, as well as on commercial names, trademarks or industrial designs and any other sign susceptible of industrial and commercial use and that the acceptance of these General Conditions and the conclusion of the Contract do not imply transfer or licence, total or partial, of any right of intellectual property on the aforementioned contents.
Furthermore, the User expressly acknowledges that the trademarks, patents, trade names or other distinctive signs affixed to the Products cannot be altered, abused, reproduced, removed, distributed or publicly communicated without the prior express authorization of JG HITECHNOLOGY.
7) APPLICABLE LAW AND JURISDICTION
These General Conditions of Use are governed by and subject to Italian law, even to the extent not expressly provided for, with the exclusion of the application of any other law.
Any dispute relating to the application, interpretation and validity of these General Conditions of Use will be subject to the jurisdiction of the Italian State and to the exclusive jurisdiction of the Court of Bologna (IT). However, the User who, pursuant to and by effect of Legislative Decree no. 206/2005, covers the quality of consumer, and who intends to establish a jurisdictional dispute relating to the application, interpretation and validity of these General Conditions of Use, may appeal to the Court of Bologna or the Court of the place where he resides or where he has his domicile if located in the territory of the Italian State. If the consumer is not domiciled in the territory of a State of the European Union, the provisions of Law no. 218/1995.
